You could have asked for the old I-140 priority date to be tranferred to the new I-140 at the time of filing the I-140. Now that the I-140 is already approved, it will be difficult to get them to make any changes on an approved I-140. Interfiling of new I-140 with old I-485 is possible once the visa number becomes available. The problem is that USCIS does not always acknowledge that they have done this, therefore you might be unsure if this was done or not. Some people prefer to file a new I-485 for this reason.

I have a question. I am on H1 and are planning to extend my H1 along with my wife H4. My question is, we both have EAD's and I never use EAD. My wife is looking for jobs on EAD. If she works on EAD, can she still able to extend H4 status?

Dear Sir/Madam:
I booked H4 visa appointment in Chennai Consulate on Oct 10th,2007.
My husband is working in US on H1b visa. He moved company A to company B on Sep 10th,2007. He has companyB H1b approval letter, but he only has one Sep month pay stub from company B.
When I am going for H4 visa stamping, I need to submit my husband's recent 3 pay stubs. Can I submit my husband previous company A pay stubs( June to Aug) with recent pay stub from company B. Is there any requirement to submit all pay stubs from one company.
Please assist me. I would really appreciate your answers.

DEPENDS on the cost of the bond/non compete agreement /penalty.if you make more money from new jobs which will eventually cover any penalties should they try to enforce a "suspect'agreement then go for the new job :).
anyway getting a salary/pay is better than thinking about getting sued.:)

There is an error in the article.
It does not say that H1B workers lack any courage and will power to stand up for themselves. They lack unity, are narrow minded and cannot work together. Their high education works in their disadvantage because they use to fight within themselves. As long as they cannot stand up and support their own cause, it is good news for anti-immigrant organizations.

RFE's during I 485 - consolidated
I though it would be a good idea to start consolidating all the RFE's, so that people would have one thread to look at if at all there is any RFE
Note: If there is already a thread, admins please delete this thread
1. RFE on current employment and offer of proposed employment (description of position) and offered salary
2. Current address proof
3. Missing G325-A need to submit one (but I did send them initially)

Make sure you get a copy of the advertisement and a copy of the link that it points to which has all the details. Make sure when you print it, it has the website link printed in the footer or header.

is it possible to apply in Delhi even if u r from Mumbai... Has any1 done tht before?
You can easily go to any consulate in India without any problems. but for reassurance you can email and ask the Delhi consulate with details.

Thanks fromnaija, do you know if it's going to take the same amount of time the get the corrected EAD or is it going to be longer than regular time, I know it depends on the service center and the processing dates, but just curious if you happen to know any such cases and the time USCIS took to process them.
I hope I don't need attorney's help in this as I have been renewing EAD since 2004 myself.

These guys did not mention specifically "legal immigrants" but to me that sounds even easier since most of them possibly have decent wages and also maintain a legally sound lifestyle.

Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

As the house will go into a recess after around a month, is anyone seeing a possibility for a congressional action regarding the three pending immigration bills in the house? �A realistic possibility?
As per the calendar, we have time till August 4 and between September 7 & September 26, to get something done in Congress. It might be really difficult to get something done in September as that short time may be used by the congress for many high priority items.
