My situation is tricky here. I would really appreciate any inputs.

My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:

Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.


Please guide me through the process and any scenarios. Thank you in advance.

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

I am a Brit, filed my I-140 and I-485 in Nebraska for my myself, wife and kids back in Jul-07. The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"

Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".

My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

Hi,

My I-140 will be approved shortly in premium processing and I'll be applying for 3yr H1 extension. There is a chance that I may get laid-off soon and I wanted to know if I can change the jobs while my H1 extension petition is pending with USICS. My current H1 will expire in June'07.

Has anyone heard about the immigrant advocacy groups that are planning a protest march on Washington one day after Obama's inaguration. They plan to demand that immigration raids stop and that immigration reform be taken up during the first 100 days of Obama's administration (while recognizing that the economy comes first)

The marches are apparently being organized by the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA). These news are very fresh and thus far I have only seen it on Spanish language media (3 different online newspapers). Here is the note in Spanish: http://www.chirla.org/node/246

I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Also, dont specify Medical emergencies. They sometimes ask you to provide letters from the doctors regarding this. You can just say that they need some more time to visit places.

Ideally, I wouldnt recommend, having them overstay. This might have issues in the future, if they plan to visit again.

If they have a 5 or 10 year multiple entry visas, they can go back home and come again in another 6 months or so.

Indian Government sources had said that the Bureau of Diplomatic Security had contacted the ministry of external affairs (MEA), India around the time Mr Pacheco was incarcerated for his alleged involvement in the mysterious death of his girlfriend Nadia Torrado � he was in jail from July 9 till July 26, when he was awarded bail. He is a former Goa, India tourism minister Francisco Xavier �Mickky� Pacheco was caught on the backfoot on Sunday once again as reports surfaced that the US State Department�s Bureau of Diplomatic Security had informed India that Mr Pacheco might be involved in a big immigration and money laundering racket.

Mr Pacheco used to operate an employment agency along with his estranged wife Sara Pacheco which specialized in finding employment for Goans abroad. But according to the former minister, he has had nothing to do with the agency since he separated from his wife around four years back.

Mr. Mickey Pacheco has been accused by the US Bureau of Diplomatic Security of running an international immigration and money-laundering racket. The bureau got in touch with the external affairs ministry through the US embassy in Delhi and reportedly backed its allegations with documents and details of banking transactions. The ministry then passed on the information to the CBI. The evidence is being described as substantive. According to the US Bureau of Diplomatic Security report, Pacheco had 15 million dollars in his account in the US. He recently transferred 2 million dollars to India.

My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.

I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .

If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

If its a new company, you need to do H1B transfer and start the GC from PERM. If the I-140 is not revoked, you can retain the PD.

Your H1-B visa approval notice for the new employer comes with the new I-94 when you renew/transfer it, that is valid till the visa expiration date on the notice. Check the apporval notice and there must be a detachable perforation at the bottom which says I-94 on it. This new I-94 needs to be attached to your passport. If you do not have it, ask your employer, they might have it. Legally, you should have that I-94 in your possession.
