Once they get your response, it will be added to your case and delivered to the officer who issued the RFE. He/she will then make a decision on your case. If at that time your PD is not current, your case can not be approved even if it is approvable, but will be sent to on hold, waiting for your PD to be current.

Mar-18 I got a mail "Case Transfered to Another Office for Processing" To NSC
Mar 19 -soft LUD
Mar 21 around 1 pm got a mail "This case is now pending at the office to which it was transferred.
Again Today around 7-15PM I got the Approval Mail..
I-140 & I-485 Concurrently mailed on July 2 nd 2007 TO NSC
Got the Receipt on Aug 22 from CSC.
Till now No FP because of NC pending...found today by Infopass Appointment..

my GC application was done in 2001 via my mom who is a GC holder.
Will IV assist in legal non employment based GC application?
or is IV only active in employment based GC issues?

Please help me on this question
I was on F-1 Visa in 2003 I applied for the labor certification through a friend's company- call it Company- A, on the intention to to work in his company as a Network administrator. I got my labor approved and I -140 is approved too. The priority date is december 2003. All these years I was waiting for my priority date to become current.Currently I work for Company B with same job title and credentials. I have an H-1 from company B.
What do you suggest
1) Shall I go ahead and apply for the I 485 from company A (company A is willing to help). Can INS ask for the pay stubs? Becoz I never actually worked at my friend's company.
2) It will take 3-4 months for company B to finish doing my labor certification and apply for my I -140. But it would be too late for the priroty date. (It may retrogress).
3)I understand that once my current company's I -140 is approved i can request to keepo my previous priority date
what shall i do now in july/august.

It is better to spread the awareness about swine flu as it is projected to strike back in the end of September and peak by the end of October. My roommate is from England. She applied for a work visa, I'm not sure which number or letter, but anyway she was supposed to apply 90 days before her studies ended up to 60 days after. She mistakenly sent the application in 94 days before she finished her studies and they denied it because of that.
I read the form and it said there is no appeal. She went to try and take care of it today and they told her not only is there no appeal, she can never apply again. Is that really right? For a simple mailing error she can't ever get a work visa now?
What other options does she have?

Your education evaluation is valid for a long period(not sure how long). I applied for my first H1 in 2000 and got education evaluation that time. Stamping didnot work out for me that time.
I applied for new H1 in 2003 and submitted same education evaluation that I got in 2000. I entered US and used same edu eval for transferring H1. I did not have any issues.
So you are fine. I dont know if this applies to all cases.

How long did you see to get your approvals after you sent the RFE's ? is it 1 week, 10 days or what was the pattern ?
